The Government of India Tuesday said that a total of 196 cases have been registered under the Protection of Children from Sexual Offences Act During 2015-2019 in Jammu and Kashmir.

The GoI was replying to questions about the Protection of Children from Sexual Offences (POCSO) across the country including the figures and measures taken.

In reply, the Minister of State (MoS) for Home Affairs, GK Reddy said that a total of 196 cases have been registered under the Protection of Children from Sexual Offences Act During 2015-2019.

The graph maintained by the Ministry of Home Affairs (MHA) reveals that between 2015 to 2019 highest number of 109 cases were registered in 2019 while no case was registered in 2017 throughout the year.

It said that 30 cases were registered in 2015, 25 in 2016, and 32 cases in 2018 taking the total cases registered to 196.

The MHA informed that the State Governments are competent to deal with such offences under the extant provisions of laws. “National Crime Records Bureau (NCRB) compiles and publishes statistical data on crimes in its publication “Crime in India”. Published reports are available till the year 2019. Analysis of this data for cases registered under various crime heads on crimes against children does not show any uniform trend”, the MHA said.

Courts (FTSCs) including 389 exclusive POCSO Courts for expeditious trial and disposal of cases related to rape and to POCSO Act.

“As per published information the Conviction Rate for POCSO cases in 2019 was 34.9”, the MHA reply said.

 The Union Minister of State for Home Affairs (MHA) G K Reddy Tuesday said that a total of 42 militant organizations have been banned in Jammu and Kashmir for being involved in unlawful activities.

In a written reply in the Lok Sabha, the MoS Home Reddy said the list of 42 organizations include the names of the militant organizations active in the country and the number of organizations which have received foreign support. “The number of militants killed during the last three years and the current year till date. The number of people victimized by the terrorists during the said period till date, State-wise. The steps taken by the Government to stop militancy till date and the extent to which success has been achieved so far?” the reply reads.

The reply further states that  said that the Government has declared 42 organizations as militant organisations and listed their names in the First Schedule of the Unlawful Activities (Prevention) Act, 1967.

“Militancy in India has largely been sponsored from across the border”, MHA said.

The MHA said that the Government has taken various steps in this regard including strengthening of legal framework, streamlining of intelligence mechanism, setting up of National Investigation Agency (NIA) for investigation and prosecution of militancy-related cases, having various hubs of National Security Guards (NSG), stepping up the border and coastal security, modernization of police forces and capacity building of state police forces, etc.

“Due to the concerted and coordinated efforts of all the stakeholders, militancy-related violence has been contained to a large extent in the country”, the MHA said.

Ministry of State for Home Affairs (MHA) G K Reddy stated this in a written reply in Lok Sahbab,In reply to a query that whether the Government has any statistics regarding the number of cases registered and several persons arrested under the Unlawful Activities Prevention Act (UAPA) in the county. if so, the details of such cases reported in the country during the last five years, year-wise and State-wise. Also another question was posed whether the Government has any plan to set up fast-track courts to handle cases registered under UAPA in each State and Union Territory; and if so, the details thereof and the steps taken by the Government in this regard?

In response, the Ministry of Home Affairs (MHA) stated that a total of 876 cases have been registered and 505 persons were arrested under the Unlawful Activities Prevention Act (UAPA) in Jammu and Kashmir between 2015 to 2019.

MHA said that the National Crime Records Bureau (NCRB) compiles the data on crime as reported to it by States and Union Territories and publishes the same in its annual publication ‘Crime in India’.

Cases under UAPA are investigated by state police and the National Investigation Agency (NIA), MHA said.

The Ministry informed that as far as NIA is concerned, so far 48 special courts have been constituted across the country for the speedy trial of militancy-related cases.

The MHA about the year-wise graph of cases and arrests said that in 2015 a total of 59 cases were registered and 10 persons were arrested. 161 cases in 2016 and 56 persons were arrested. In 2017 a total of 156 cases were registered and 35 persons were arrested.

In 2018 total of 245 cases were registered under UAPA and 177 persons were arrested and 255 cases were registered in 2019 and 227 persons were arrested, MHA said—(KNO)
