14-months-old Zikra’s case: Admin constitutes committe to probe alleged medical negligence

Committee headed by CMO Sgr asked to submit report within 15 days

SRINAGAR, JANUARY 11 :

The district administration has constituted a committee to investigate the alleged medical negligence in the case of 14-month-old Zikra.

According to the news agency—Kashmir News Observer (KNO), Additional District Magistrate Srinagar as per an order has constituted a three-member committee headed by Chief Medical Officer (CMO), Srinagar, who has been appointed as Chairman of the group.

“Sanction is hereby accorded to constitution of the following committee for fixing responsibility for alleged medical negligence at ASG Hospital Srinagar in the case of minor baby girl namely Zikra (aged 14 months).

Chief Medical Officer, Srinagar will be Chairman of the committee while Representative Opthamology Department, SMHS, Srinagar will be its member and any other expert to be co-opted as member by CMO, Srinagar, the order reads

The above committee shall submit its report to the office of the Distict Magistrate, Srinagar within a period of 15 days from the date of issuance of this order, the order reads.

Pertinently, KNO has carried a detailed Story over the alleged medical negligence wherein the family had stated that an overdose of anaesthesia by the medicos at a private hospital in Srinagar has damaged the brain of a 14-month-old baby girl when she was undergoing treatment a year ago.

However, the family of the girl had said the authorities at the hospital don’t even bother to accept the guilt rather challenged them to file a case against them—(KNO)

SC ‘extremely disappointed’ with Centre’s negotiation on farm laws

The Supreme Court Monday pulled up the Centre for its handling of the farmers protest against the new farm laws saying it is “extremely disappointed” with the way negotiations between them were going and it will constitute a committee headed by a former Chief Justice of India to resolve the impasse.

Indicating amply that it may go to the extent of staying the implementation of the contentious farm laws, the apex court refused to grant extra time to the Centre to explore the possibility of amicable solution saying it has already granted the government a “long rope”.

“We have given you long rope, Mr Attorney General, please don’t lecture us on patience,” a bench headed by Chief Justice S A Bobde said.

Solicitor General Tushar Mehta told the bench, also comprising Justices A S Bopanna and V Ramasubramanian, that the top court has made “harsh observations” regarding handling of the situation by the government.

“That was the most innocuous factual thing for us to say,” the bench said.

The apex court, which said it will pass orders on the issue concerning farm laws and farmers’ protest in part in the matter, asked the parties to suggest two-three names of former CJIs including former CJI R M Lodha who can head the apex court-appointed panel.

At the outset, the bench said, “What is going on? States are rebelling against your laws”.

“We are extremely disappointed with the negotiation process,” it said, adding, “We don’t want to make any stray observations on your negotiations but we are extremely disappointed with the process.”

The apex court, which was hearing a clutch of pleas challenging the new farm laws as well as the ones raising issues related to the ongoing agitation at Delhi borders, said it is not talking about the repeal of these farm laws at the moment.

“This is a very delicate situation,” the bench said, adding, “There is not a single petition before us which says that these farm laws are beneficial”.

“We are not experts on economy; you tell us whether government is going to put on hold farm laws or we will do this,” the bench said. “We are sorry to say that Centre has not been able to solve the problem and the farmers agitation.”

Attorney General K K Venugopal argued that a law cannot be stayed unless the court finds it violates fundamental rights or constitutional schemes.

“Our intention is to see whether we can find an amicable solution to all this. That is why we had asked you (Centre) whether you are willing to keep these laws on hold for sometime. But you wanted to buy time,” the bench observed, adding, “We don’t know whether you are part of the solution or part of the problem”.

The apex court, which said the matter is getting worse and people are committing suicides, reiterated the need for having a committee comprising representatives from the government and farmer organisations from over the country and said it will stop the implementation of these laws if the panel advises to do so.
It said farmers are protesting against these laws and they can tell their objections to the committee.

The bench warned that it may stay the law if the government does not do it on its own.

“Whether you have faith or not, we are the Supreme Court of India, we will do our job,” the bench told the farmer unions which are protesting against these farm laws.

The bench said it did not know whether the protesting farmers were observing social distancing amid the COVID-19 pandemic but was concerned about them getting food and water.

The bench also expressed apprehension that there might be some incident which may breach the peace.

It said after the implementation of these laws are stayed, the protestors can carry on with the agitation as the court doesn’t want “anyone to say that we stifled the protest”.

The top court observed that talks are breaking down because the Centre wants to discuss the new farm laws point by point but the farmers want them repealed.

“We are not going to protect any law breakers. We want to prevent the loss of property and lives,” it said.

When the issue of law and order was raised before the bench, “These issues will be taken care by police. Right to protest is intact and Gandhiji exercised Satyagraha. That agitation was much bigger”.

When the attorney general told the court that next meeting between the government and farmers is scheduled for January 15 and the court should not pass any order today, the bench said, “We do not think the Centre is handling the issue correctly. We have to take some action today. We don’t think you are being effective.

“If laws are put on hold then negotiations will have a chance to work out”.

“Let me take a risk and say Chief Justice of India wants them (protesting farmers) to go back to their homes,” the CJI said.

The eighth round of talks between the Centre and the farmer unions on January 7 headed nowhere as the Centre ruled out repealing the contentious laws, while the farmers’ leaders said they are ready to fight till death and their ‘ghar waapsi’ will happen only after ‘law waapsi’.

The apex court had earlier issued notice and sought the Centre’s response on a batch of pleas against the three contentious farm laws — the Farmers’ (Empowerment and Protection) Agreement on Price Assurance and Farm Services Act, the Farmers’ Produce Trade and Commerce (Promotion and Facilitation) Act, and the Essential Commodities (Amendment) Act.(PTI)

Petition: Will SEC disqualify 10 Congress Corporators for defying party whip?

At least 10 Corporators of Congress party who deified the party whip today appeared before State Election Commissioner of Jammu and Kashmir.

Congress Party has filed a petition seeking disqualification of these Congress Corporators who went against party whip and voted for the incumbent Srinagar Mayor Junaid Azam Mattu.

On the directions of Jammu Kashmir Congress President G.A Mir and senior Congress leader Tariq Hameed Karra, whip was issued through Chief Whip Basharat-Bin- Qadir to vote in favour of Sheikh Muhammed Imran in recently concluded Mayoral elections.

Ten Corporators from Congress party defied the whip and instead of voting for Sheikh Muhammad Imran voted for Junaid Azam Mattu.

Sources told Kashmir News Trust that Congress Chief Whip Basharat-Bin- Qadir who is also a Corporator filed a petition before State Election Commissioner K.K. Sharma seeking the disqualification of these 10 ‘turncoats’.

These 10 rebel Corporators were Shafat Ghaffar, Ziyarat Batamaloo (Ward 21), Farooq Dar – Chanapora (Ward 11), Sara Bilal – Lokut Dal (Ward 64), Zahoor Hussain Rather – Hamdania Colony (Ward 17), Haseena Bano- Chattarhama (Ward 73), Shameema Khan – Bemina East (Ward 26), Gulshan Bilal – Syed Ali Akbar (Ward 34), Showkat Kak – Makhdoom Sahib (Ward 41), Syeda – Shaheed Gunj (Ward 22) and Ghulam Rasool Hajam – Zainakote (Ward 30).

The Counselor for the applicant, Advocate Shujah-ul-Haq told Kashmir News Trust that all the 10 Corporators appeared before the Election Commissioner. These Corporators sought time to file their objections. “The time to file objections was granted and the case was listed for the next hearing on 11 February next month,” he said adding that the applicant has vehemently pleaded that all these 10 Corporators violated election rules and ought to be disqualified.

The Mayor candidate Sheikh Muhammad Imran against whom these Corporators voted in a tweet said that the good thing is that even the Congress Party can’t forgive these Corporators this time because, the Law says so and he would simply say Congress Corporators will be disqualified from the Council for defying party whip for money.

The incumbent Mayor Junaid Azam Mattu had secured 44 out of 70 votes in recently concluded Mayoral election at Srinagar Municipal Corporation. (KNT)

A special TADA/ POTA court today framed the charges against separatist leader Muhammad Yasin Malik in the case of Rubiya Sayed kidnapping.

Official sources told news agency—Kashmir News Observer (KNO), that 3rd Additional Sessions (Special judge TADA/POTA) Jammu, framed the charges against Malik regarding Rubiya Sayeed kidnaping case.

Earlier, on March 16, last year presiding officer of TADA court in Jammu had framed charges against  Malik and six others for killing four IAF men in 1990—(KNO)

Rice mill owner dies after getting trapped in machine in Bandipora

BANDIPORA, JANUARY 11 :

Owner of a rice mill was killed after he got trapped in the machine at Shahgund area of the this north Kashmir district on Monday.

Official sources told GNS that the mill owner identified as Abdul Majeed Dar son of Abdul Kareem Dar of Shahgund was immediately removed to community health centre at Hajin. However, the dactors declared the 60-year-old brought dead at the arrival. Further details are awaited. (GNS)

JK Employees Joint Action Committee (EJAC) calls for roll back of SRO-130… Calls it injustice with civil service aspirants of Jammu and Kashmir

JK Employees Joint Action Committee (EJAC) reacted strongly to the enforcement of SRO-130, calling it unnecessary and unjustified.
President Employees Joint Action Committee Mohd Rafique Rather in a statement issued to press today said that when we need to encourage our youth to pursue competative exams at local, national and international level, goverenment has come up with SRO-130 which closes the doors of competative exams for our youth thus leaving them more frustrated.
Rafique Rather said that what is the rationale behind reducing the upper age limit from 37 to 32 for civil service aspirants when in most of States its 38 to 40 and added that since Jammu and Kashmir has been witnessing a very difficult situation on account of uncertanity and unemployment for many years now thus youth of JK deserve much fair treatment and relaxation in pursueing their dreams by participating in prestigious competative exams such as KAS and IAS.
Rafique Rather said that like other States Civil Service exams have not been held as per routine here and aspirants have been preparing for it for many years, thus reducing the age limit to 32 years by application of SRO-130 has come as a bolt out of the blue for them and added that the move will add to their stress and make situation more gloomy for them.
Rafique Rather urged upon Honb`le LG Manoj Sinha to personally intervenve and redresses the serious issue by increading uper age limit to 40 years,so that civil servant aspirants get a sigh of relief.

Sopore Police solved theft case, accused arrested, stolen property recovered.

SOPORE, 11 JANUARY 2021:

On 05 January 2021 Police Post Watergam received a written complaint from one Javaid Ahmad Mir S/O Mohammad Dilawar Mir R/O Rohama Rafiabad, proprietor of Peace Automobiles located at Saidpora Rafiabad & stated therein that theft has happened in his workshop, as thieves have broken the shutter and stolen the generator and motor.

On this information a case FIR No. 08/2021 U/S 454, 380 IPC was registered in Police Station Dangiwacha and investigation was taken up .

During investigation, police inspected scene of occurrence & completed all legal formalities, some suspects were identified.

The suspects were called to PS for questioning, after verifying the facts and proper investigation one suspect was zeroed and apprehended alongwith other two accomplices & while questioning they disclosed their involvement in the said crime & on their disclosure the stolen property worth lacs were recovered.

The case has been worked out just within the period of 5 days by Sopore Police under the supervision of SDPO Rafiabad Shri.Nissar Ahmad-JKP. The team of Rafiabad Police comprising of SHO Police Station Dangiwacha Insp. Dr. Yasar Mehmood, DO Police Post Watergam SI Imitiyaz Ahmad played a vital role during the investigation of the case.

Blaze damages Tehsil office partially in Tangmarg

The top floor of Tehsil office Tangmarg in north Kashmir’s Baramulla district was damaged in a blaze that broke out on Monday morning.

According to the news agency—Kashmir News Observer (KNO), fire broke out at Tehsil office Tangmarg in this morning.

Locals said the fire tenders reached the spot and are dousing the flames.

ANANTNAG JANUARY 11 :

The Deputy Commissioner of Anantnag suspended 17 Doctors from the Maternity and Childcare hospital in Anantnag on Sunday who were found absent from their duties, which triggered anger among the doctors who have started a ‘pen-down’ strike in Anantnag to protest against the decision of the Deputy Commissioner, Anantnag, KK Sidha.

On Monday morning, as hundreds of patients from different parts of South Kashmir reached the hospital, the Doctors refused to check the patients in view of their strike against the move of the DC Anantnag.

A patient speaking to The Kashmiriyat said, “We reached the hospital around 9 AM and since then, we have been waiting for a doctor to see my old mother, but the doctors refused to do so, saying that they were on a strike.”

Several patients who had come from various South Kashmir areas upon receiving a similar response from the doctors, after being constantly refused medical attention shouted slogans against the Doctors and hit the streets to protest against the “inhumane behavior of the doctors.’

This has led to severe traffic jams in the whole town where the snow-clearance operations have also come under a scanner recently, hundreds of vehicles are stranded for past several minutes on the streets.

Speaking to The Kashmiriyat, a doctor said that the Deputy Commissioner did not even check the roaster, he suspended almost everyone posted in the hospital. “The DC should know that there is something called roaster in the hospital and he cannot suspend doctors who were off-duty when he visited.”

Pertinently hundreds of patients from various parts visit GMC hospital in Anantnag from various parts of South Kashmir as it is the biggest hospital down in South Kashmir.
