ACB attached palatial residence and banquet hall, situated at Udhampur, worth crores of Rakesh Kumar Pargal, the then Chief Supervisor, FCI Godown, Udhampur

Anti Corruption Bureau attached the properties worth crores belonging to Rakesh Kumar Pargal, the then Chief Supervisor, FCI Godown, Udhampur & former Incharge Vigilance Squad in Food Civil Supplies and Consumer Affairs. This is in addition to earlier attachment by ACB of Dogri Haveli, Udhampur.

2. On the basis of a Preliminary Enquiry to verify the facts that Rakesh Kumar Pargal, Chief Supervisor, FCI Godown, CA&PD Udhampur and Incharge Vigilance Squad in Food Civil Supplies and Public Distribution Department, by indulging in corrupt and illegal practices, has amassed huge assets worth crores of rupees in the form of immovable/moveable properties disproportionate to his known sources of income. During preliminary enquiry it was found that official has raised assets several times higher than the genuine income (salary) earned by the official from the service period.

3.     During enquiry, it surfaced that Rakesh Kumar Pargal has amassed huge assets worth crores of rupees in his own name and in the name of his family members. Accordingly Case FIR No. 01/2020 in PS ACB Udhampur was registered against him. After registration of FIR, searches were conducted during which 285 gms gold, incriminating material, documents were seized. Some accounts/lockers were also freezed after being found suspicious. Rakesh Pargal is also involved in Case FIR No. 01/2020 in PS ACB Doda regarding misappropriation of Rs.260 Crores on account of cost of wheat grains, transportation charges, labour charges, grinding charges drawn on the basis of fictitious and false bills. He was also arrested by ACB in this case.

4. It is pertinent to mention here that he was initially appointed as daily wager in September, 1984 in TSO office Chenani and remained posted in AD office Udhampur, Chief Supervisor (FCS&CA) Deptt) FCI Godown Udhampur. He remained under suspension w.e.f 26-06-2009 to 19-09-2012 (Attached with Directorate Office Jammu) for his involvement in case FIR No.06/2009 u/s 109, 409, 468, 471 RPC r/w sec 5(1) (c ), 5 (1) (D), 5(2) JK PC Act Svt. 2006 P/S VOJ now ACB which is still under trial in the Hon’ble Court of Special Judge, Anti-Corruption Udhampur. After the registration of formal case under Anti-Corruption Law and his suspension from Govt. service w.e.f 26-06-2009 to 19-09-2012 he was posted/ appointed in Enforcement squad and Vigilance squad in CAPD Department, which indicate his deep nexus with other accused officials and private persons.

5.During the course of investigation it has been found that the accused Rakesh Kumar Pargal by indulging in corrupt and illegal activities has raised commercial building namely Feeling Farm Banquet Hall worth crores of rupees on land measuring 07 Kanals and 05 marlas on the name of  Amit  Mahajan and Sumit Mahajan Ss/o Kasturi Lal Mahajan R/o 51 B/C Gandhi Nagar and one three storey residential building worth crores at Rakh Badali, Devika Vihar Colony Udhampur purchased by Amit  Mahajan and Sumit Mahajan Ss/o Kasturi Lal Mahajan, Veena Mahajan W/o Kasturi Lal Mahajan and Late Kasturi Lal Mahajan S/o Sardari Lal Mahajan R/o 51 BC Gandhi Nagar from J&K Cooperative Housing Corporation Ltd Jammu as Benami Properties.

6.The Feeling Farm Banquet Hall and Residential Buildings have been attached by Anti Corruption Bureau under Section 8-B of J&K Prevention of Corruption Act. Svt. 2006.

7. Further investigations in both the cases is going on.

56-day-long Amarnath Yatra 2021 to begin from June 28

ANANTNAG, MARCH 13 :

The 56-day-long annual pilgrimage to the holy cave shrine of Amarnath in South Kashmir Himalayas will commence on June 28 and will conclude on August 22.

Officials told the news agency—Kashmir News Observer (KNO) that the decision over the commencement of Amarnath pilgrimage from June 28 this year was taken in a meeting of the board of Shri Amarnathji Shrine Board (SASB).

Due to the Covid-19 pandemic across the world, the Amarnath Yatra was cancelled last year in Jammu and Kashmir.

The authorities had said that the yatra would begin on July 21 and continue till August, however, due to the surge in covid-19 positive cases, the decision was rolled back.

Pertinently, cases have again started to surge in several States of India but board has decided to hold the event keeping with the covid-19 guidelines.

The Board has said that to keep religious sentiments alive, it will continue the live telecast/ virtual darshan of the morning and evening Aarti besides that the traditional rituals will be carried as per past practice.

Notably, Amarnath Yatra was cancelled mid-way in year 2019 in wake of the abrogation of Article 370 and bifurcation of the erstwhile State of Jammu and Kashmir on August 05, 2019.

Situated in a narrow gorge at the farther end of Lidder Valley, Amarnath shrine stands at 3,888 metres, 46 km from Pahalgam and 14 km from Baltal—(KNO)

South Kashmir: Encounter breaks out in Shopian

SRINAGAR, MARCH 13 :

Encounter has started between militants and government forces in Rawalpora area of South Kashmir’s Shopian district on Saturday.

Reports reaching GNS that a joint team of Police and Army launched a cordon and search operation in Rawalpora.

As the joint team of forces approached towards the suspected spot, the hiding militants fired upon the forces, triggering off an gunfight.

A senior police officer also confirmed to GNS about exchange of firing between militants and security forces.

As per the sources two to three militants are believed to be trapped.(GNS)

Court convicts Javed Ahmad Bhat of Kremshore, Khansahib under section 302 RPC

Today the Court of Principal Sessions Judge Srinagar, Abdul Rashid Malik has convicted Javaid Ahmad Bhat Son of Abdul Gani Bhat a resident of Kremshore Khan Sahib, Budgam

Under Section 302 RPC for causing the death of Mst. Gulshan Akhtar D/o Ghulam Hassan Sofi Resident of Kremshore.

As per the history of the case, on June 03, 2014 Police Station, Khansahib received information from reliable sources that the dead body of Mst. Gulshan Akhtar is lying in Kremshore and by appearance it looks that she has been killed by strangulation. On receipt of the said information, case FIR was registered under Section 302 RPC and investigation was started.

During investigation, site plan was prepared and dead body was taken into custody/possession by police, photography was conducted, at the place of occurrence some blood stained grass was collected/seized with the help of FSL team for the purposes of chemical examination. One blanket was also seized which was used to cover the dead body.

The Dead body was taken to hospital -for post-mortem, where cloths were seized and one blood stained scarf was also seized. After post-mortem dead body was handed over to legal heirs for last rites. The blood stained grass and scarf was sent to FSL for chemical examination. The statements of witnesses vis-à-vis the seizure were recorded, the order reads.

The order mentions that the trial court examined 21 (twenty one) witnesses. After hearing Qazi Qayoom, learned PP and counsel for the accused, the learned Principal Sessions Judge Srinagar Abdul Rashid Malik observed that the prosecution has cogently and firmly established the circumstances from which the inference of guilt can be drawn.

The circumstances are definite and unerringly point out towards the guilt of the accused. The circumstances cumulatively form the chain, so complete that there is no other explanation of any other hypothesis than that of the guilt of the accused and the evidence is consistent with the guilt of the accused and inconsistent with his innocence.

When after the deceased left the home she was not seen by anybody and later on after two days her body was found on the spot of occurrence and the accused in the disclosure statement has explained the circumstances which left no doubt in the mind of this court that it was the accused who has committed the murder of the deceased.

The Police had no reason to falsely implicate the accused and the accused has failed in examination under Section 342 Cr.P.0 to explain the incriminating circumstances because once the prosecution has discharged the burden of proof, the accused cannot chose to remain silent as adverse inference can be drawn.

The accused has not explained his constant contact with the deceased, the knocking of the windows, providing the mobile phone to the deceased, motivated the deceased to come out of the home, the conversation with the deceased and recovery of the incriminating articles from the possession of the accused.

There is no doubt that mere recovery of the incriminating articles is not sufficient to prove the guilt of the accused but the recovery is supported by the detailed disclosure statement made by the accused before the Investigating Officer in presence of the Executive Magistrate and the Dy.S.P. There is not even an iota of evidence that the accused was wrongly implicated.

The Investigating Officer has made all the sincere efforts to unfold the truth. The circumstances in this use are knit brick by brick with the support of the documentary evidence. All the twenty one witnesses have spoken consistently in support of the prosecution story and their statements inspire the confidence of the court Right from the lodging of the FIR, arrest of the accused, the disclosure statement of the accused, the recovery of mobile phone, battery, damaged SIM card, the chapel of the deceased, the scarf round the neck of the deceased, the blood soaked grass, the FSL report, postmortem report and call details point out nothing except the guilt of the accused.

There is not even a single circumstance which point out towards the innocence of the accused. The silence of the accused in the face of the cogent, oral and documentary evidence further strengthens the prosecution story. The accused has failed to explain his innocence in the light of the chain of circumstances established by the prosecution

The Court further observed that in appreciating evidence the approach of the Court must be integrated not truncated or isolated. In other words the integrate of the evidence in totality on the prosecution case or innocence of the accused has to be kept in mind in coming to the conclusion as to the guilt of the accused, the Court has to appreciate, analyze and assess the evidence placed before it by the yardstick of probabilities, its intrinsic value of the witness.

The Court while appreciating the evidence should not lose the site of the realities of the life and cannot afford to take an unrealistic approach by stating in an ivory tower. It is very easy to pass an order of acquittal on the basis of minor points raised in a case by a short judgment, so as to achieve the yardstick of the disposal. Some discrepancies are bound to be there in each and every case while should not weighed that the Courts are wrong. It does not materially affect the prosecution case. In case the discrepancies pointed out are in the realm of pebbles, Court should act upon it, but if the same are boulders, Court should not make an attempt to jump over the same. The proof beyond reasonable doubt is a guideline and guilty-man cannot get away with it, because truth suffers some infirmity when projected through human processes.

Therefore, the evidence produced by the prosecution establishes beyond reasonable doubt that the accused had only intention to kill the deceased after his love affair failed and the motive behind the killing was the refusal of the parents of the deceased to marry the deceased with the accused. The accused strangulated the deceased till she died by wrapping the scarf around her neck and pressed it so hard that the deceased died instantaneously. Therefore, the offence committed by the accused falls under section 302 RPC and the accused is convicted under section 302 RPC accordingly.

DAK aghast over step-motherly treatment with Doctors from Health department in Associated Hospitals of New Govt Medical Colleges of J&K

, Doctors Association Kashmir (DAK) today expressed its serious concerns over step-motherly treatment with doctors from health department who are working on deputation in newly formed Govt Medical Colleges of Jammu and Kashmir. A delegation of such doctor’s called upon Central members of the Association and apprised the members that most of the senior specialists, specialists and super-specialist doctors are forced to work as either as junior residents or as multiple purpose medical officers rather than assigning them expert and stream specific job for which they have been deputed to such associated Hospitals

DAK President Dr Suhail Naik, said it will be better for large patient interest and smooth functioning of hospital if the services of these consultants, specialist and super-specialist doctors from health dept are utilised in analogy with faculty members of GMCs .There will be harmful effects of this notion to create hurdles and obstruction in working of such doctors of health department.

Genral Secretary DAK, Dr Owais H Dar said it’s unfortunate that the doctors from health department are pushed to wall in New GMCs. It should not be made as a matter of Ego between faculty members and specialist doctors of health with same or more qualification.
Degrees and experience of these specialist/ super specialist doctors should be respected and giving them optimal space for work so that there is a positive impact in-terms of services provided to public at large . Furthermore it will also help in reducing the referrals to Tertiary Care Hospitals of srinagar. It has also been brought in notice of DAK that while faculty members are allowed to proceed on vacations but many a times consultants from Health Department are not being allowed to proceed on earned leaves which is their legal right

Conducive and cordial work environment is need of the hour for optimal working and growth of departments in these newly formed GMCs.

Doctors Association Kashmir (DAK) requests Financial Commissioner Health and Medical Education Dept, Shri Attal Dullo to intervene in this sensitive matter so that long sufferings of Doctors as well as patients is put to an end in the larger interest of Health Care Delivery system.

3 covid-19 deaths, 99 fresh cases in J&K

Thirty travellers were among 99 fresh covid-19 cases reported in Jammu and Kashmir even as three persons succumbed to the virus in the last 24 hours, officials said on Saturday.

Among the fresh cases, 24 were from Jammu Division and 75 from Kashmir Valley, taking the total tally to 127535.

Among the fresh cases, the officials told GNS that Srinagar reported 42 cases, Baramulla 12, Budgam 6, Pulwama 2, Kupwara 0, Anantnag 4, Bandipora 2, Ganderbal 2, Kulgam 2, Shopian 3, Jammu 14, Udhampur 1, Rajouri 0, Doda 0, Kathua 0, Samba 2, Kishtwar 0, Poonch 1, Ramban 0 and Reasi 0.

Regarding the fresh deaths, they said, two were reported from Kashmir Valley while one was from Jammu, taking overall toll in J&K to 1974—730 in Jammu and 1244 in Valley.

Moreover, they said, 102 more COVID-19 patients have recovered and were discharged from various hospitals—11 from Jammu Division and 91 from Kashmir Valley.

There are 881 active cases—202 in Jammu and 679 in Kashmir. So far 124680 have recovered—51262 in Jammu and 73418 in Kashmir.(GNS)

Jammu and Kashmir Police Saturday released the list of eight wanted militants operating in Srinagar and city outskirts stating that the anyone who provides information about these militants will be “suitably rewarded.”

The news agency—Kashmir News Observer (KNO) is in possession of  a lookout notice framed by the J&K Police, that reads: Wanted Militants—Wasseem Qadir Mir of Shahzadpora, Nowgam Srinagar, who joined militancy on December 20, 2020, Shahid Khursheed resident of Methan, Chanapora, date of joining militancy—February 6, 2021, Irfan Ahmed Sofi of Astan Mohalla, Natipora, who joined militancy on December 14, 2020, Bilal Ahmed Bhat of Natipora, date of joining militancy February 14, 2020, Saqib Manzoor DAr of Old Barzulla, Srinagar, who joined militancy on August 5, 2020.

The police list also reads that among the wanted militants are Abirar Nadeem Bhat of Eidgah, Mohalla, Narbal, date of joining December 12, 2018, Muhammad Yousuf Dar alias Iss Kantroo, a recycled militant who joined militancy in 2012 and again in 2015, another one is Muhammad Abbas Sheikh of Rampora Koimoh, Kulgam and Ubaid Shafi Dar of Firdousabad, Batamaloo, Srinagar.

The police lookout notice has landline and mobile numbers for anyone who has information about the wanted eight militants. “Informer shall be suitably rewarded,” the police notice reads—(KNO)

Sopore Grenade Blast: One Of the 2 Injured Cops Discharged After First Aid, Says SSP Sopore

SRINAGAR, MARCH 13 :

Two SPOs suffered minor injuries in a grenade blast on Police post near Bus Stand in Sopore area of North Kashmir’s Baramulla district on Saturday.

Official sources told GNS that militants hurled grenade at Police Post at Bus stand. In this incident, two SPOs—Mohammad Afzal and Azad Ahmad — received minor injuries and were shifted to nearby health facility.

Senior Superintendent of Police (SSP), Sopore, Javaid Iqbal told GNS one of the injured was immediately discharged after first aid while another also has minor injuries. He said that a case has been registered and investigations have been set into motion.

Meanwhile, sources said, entire area was cordoned off immediately to nab the fleeing militants, they said. (GNS)

Lt Governor leads “Azaadi Ka Amrut Mahotsav” celebrations in J&K

Lieutenant Governor, Manoj Sinha led the “Azaadi Ka Amrut Mahotsav” celebrations in J&K by visiting Bagoona, Samba, the birthplace of first recipient of Maha Vir Chakra Brigadier Rajinder Singh, where he inaugurated the curtain raiser event of the mega celebrations.

The Lt Governor paid floral tributes to Brigadier Rajinder Singh and flagged off a bike & cycle rally and tableau to mark the occasion.



The inaugural ceremony witnessed a series of events filled with patriotic ethos giving glimpses of the 75 weeks long commemorative celebrations of the 75th Independence Day.

Speaking on the occasion, the Lt Governor called upon the people to actively and enthusiastically participate in Azaadi Ka Amrut Mahotsav and renew their resolve to build a new India together.

“A New India – as Prime Minister Narendra Modi had called for in his address to the nation from the ramparts of Red Fort on August 15, 2017 should emerge on the 75th anniversary of Independence in 2022 from the joint strength of all”, said the Lt Governor.

The Lt Governor observed that the mega celebrations should hold the spirit of freedom movement, express gratitude to the martyrs, and reflect the glory of Sanatan Bharat and Modern India, while displaying the spirituality of mystics and contribution of our scientists.

In order to commemorate 75 years of India’s Independence, we must demonstrate our shared commitment to fundamental values of harmony, Sarv Dharma Sambhav, freedoms and duties and work towards sustainable and inclusive development so that prosperity reaches to all, said the Lt Governor.

Terming March 12 as a major milestone in India’s freedom struggle, the Lt Governor observed that the day is of great significance as it captures Mahatma Gandhi’s another non-violent feat to achieve freedom through Dandi March from Sabarmati Ashram in 1930.

Expressing his privilege of coming to the holy land of Rajinder Singh Pura, the Lt Governor observed that the culture of our country teaches us that one must visit a pilgrimage site before starting the festivities.

“Today my desire is fulfilled. I visited the holy birthplace of Brigadier Rajinder Singh, who is an epitome of unmatched valour and sacrifice. From his birth place, I extend my greetings to the people of Jammu and Kashmir on the launch of Azaadi Ka Amrut Mohatsav”, said the Lt Governor.

Paying tributes to Brigadier Rajinder Singh, the Lt Governor saluted the courage displayed by him and his soldiers while safeguarding the territorial integrity of Jammu and Kashmir.

I have read the stories of Brigadier Rajinder Singh many times and have lived through the tales of his soldiers’ gallantry at Uri in October 1947, added the Lt Governor.

Story of Brig Rajinder Singh will be included in textbooks to make the new generation aware about gallantry of our Martyrs and freedom fighters, who sacrificed their lives to protect our land, maintained the Lt Governor.

He further stressed on telling the story of courage of Subedar Parkash Singh, Subedar Major Swarn Singh, Sepoy Balak Ram, Havildar Khajan Singh, Nayak Balwan Singh Salathia and many more, who were the companions of Brigadier Rajinder Singh.

The spirit with which Brigadier Rajinder Singh, Maqbool Sherwani and Women Self Defense Corps protected the composite culture of Jammu and Kashmir and every inch of the land by putting their lives at stake, with the same spirit, J&K government is making untiring efforts to develop every inch of the UT’s land to the standards of mainstream, said the Lt Governor.

J&K must strive to reach milestones set out by our founding fathers. The dream of Jammu and Kashmir foreseen by Brigadier Rajinder Singh, the land on which Shaivadarshan, Buddhist, Mimamsak, Naiyayik, Siddha, and Sufi philosophy flourished, that Sanatan tradition must reach every school, college, village, city in the 75 weeks to come, the Lt Governor added.

The Lt Governor asked J&K Academy of Art, Culture & Languages and Information Department to collect details of our unsung Heroes, so that their valour could be highlighted during the grand festival.

Apart from this, inspiring stories of great personalities and women of J&K who led by example and contributed in different fields of society, need to be shared, he added.

The Lt Governor said that the contribution of every class and section of the society must reach to the people through public participation programs under five pillars of this national festival that are Freedom Struggle, Ideas at 75, Achievement at 75, Actions at 75 and Resolve at 75, envisioned by Prime Minister .

Speaking on the present development scenario of Jammu and Kashmir, the Lt Governor observed that the last 2 years have seen an increased pace of development. Roads are being constructed at three times the earlier speed; efforts are being made to complete the power and water projects pending for years, so that people of the UT get all the basic facilities, he added.

Few vested interests hampered the development reaching the doorsteps of the people for decades. The temporary system that had been in place for years, the laws that pushed the people back, was not removed even after decades. Since 05 August 2019, hundreds of such policies have been changed and laws abolished. Now, the poor, the underprivileged, our farmers and the younger generation are being empowered, maintained the Lt Governor.

Highlighting the people centric measures taken by the Government, the Lt Governor observed that the population living in 973 villages will be connected with paved road for the first time after independence, now the child of a sweeper can become a doctor, and remote villages would see 20-22 hours of electricity in the next three-four years.

The Lt Governor termed the development work being done in a transparent way in every panchayat as a true tribute to Brigadier Rajinder Singh and his soldiers.

While speaking on the importance of empowered grass-root democratic setup, the Lt Governor assured that the government will make every possible effort to make DDC institution strong, vibrant and transparent.

The Lt Governor also called upon the people to remember those freedom fighters who could not find a place in the pages of history.

He urged both the administration, and the public to recognize the contributions of the people who have inspired the present generation to participate in the new ideas, industrialization and revolution happening in every field which is also the basic spirit of this Amrut festival. With the resolve of Ek Bharat Shreshtha Bharat, we also have to contribute for the self-reliant Jammu and Kashmir, he added.

Underscoring the significance of empowering the younger generation, the Lt Governor laid special emphasis on providing youth with prospects for the future, investing more in education & skills and strengthening the position of girls & young women in society.

J&K has a glorious history of Women Empowerment. Along with social and economic freedom, they have to be provided equal opportunities in the workforce as well, said the Lt Governor.

Keeping in mind 75 years of independence, the J&K Government has launched a Super-75 scholarship scheme to support the education of meritorious girls belonging to poor families. Besides, Tejaswini program has been launched under Mission Youth, to provide financial assistance to the girls to start their business aiming at strengthening Women Entrepreneur Ecosystem in J&K, he added.

The Lt Governor called upon all stakeholders to take a pledge to collectively work on Industry 4.0.

In the next 75 weeks, we have to focus on policy, funding models, focus areas, key drivers, barriers and strategy implementation, so that when the nation celebrates 75th Independence Day next year, we should be fully ready for a radical change in both the economic and social sectors, observed the Lt Governor.

We have to put our efforts in the same direction so that when the new generation celebrates the 100th Independence Day of the country in 2047, it has a rich tradition that has been raised on the occasion of 75 years, the Lt Governor maintained.

I would urge the people of J&K, to take an active part in the celebrations in the next 75 weeks along with hoisting the tricolor in their houses, government offices, schools and colleges, said the Lt Governor.

He also invited suggestions from all to make the “Azaadi ka Amrut Mahotsav” grand and successful.

Earlier, the Lt Governor inspected the Photo Exhibition on India @ 75- celebrating 75 years of India’s Independence and displaying the life story of Brigadier Rajinder Singh.

School students and Artists from J&K Academy of Art, Culture and Languages presenting cultural performances on patriotic themes marked the beginning of the mega celebrations.
