DLSA Organises Special Lok Adalats across Baramulla

BARAMULLA 06 MARCH:

District Legal Services Authority (DLSA) Baramulla and Tehsil Legal Services Committees of District Baramulla today organised Lok Adalats across the district. At headquarter Baramulla, it was organised at District court complex Baramulla whereas lok adalats were organised by the concerned subordinate courts at tehsil levels.

The Lol Adalat was held under the Chairmanship of Sanjay Parihar, Chairman District Legal Services Authority (Principal District and Sessions Judge) Baramulla and under the Supervision of Faizan ul Haq Iqbal who is also Secretary District Legal Services Authority.

Lok Adalat comprised of 09 benches which were constituted in the entire district. A total number of 426 different cases/ matters were taken up, out of which 213 cases/ matters were settled amicably on spot. An amount of Rs. 25,11,300 was also recovered as the settlement amount.

Pakistan PM Imran Khan wins trust vote in National Assembly

ISLAMABAD, MARCH 6 :

Pakistan Prime Minister Imran Khan on Saturday won a trust vote in the National Assembly amid a boycott call by the Opposition parties, strengthening his government”s legitimacy after an embarrassing defeat of the finance minister in the hotly-contested Senate elections.

Prime Minister Khan secured 178 votes in the 342-member lower house of Parliament during a special session convened on the directives of President Arif Alvi. A total of 172 votes was needed for a simple majority.

The floor test took place without the Opposition as the Pakistan Democratic Movement (PDM) – an alliance of 11 parties – boycotted the voting.

The 68-year-old cricketer-turned politician had decided to take a vote of confidence in the lower house of Parliament after his finance minister Abdul Hafeez Shaikh was defeated in the closely-fought Senate election on Wednesday. The Opposition demanded the Prime Minister’s resignation after the debacle.

Foreign Minister Shah Mahmood Qureshi tabled a single-point resolution in the House.

“That this House reposes confidence in the Prime Minister of the Islamic Republic of Pakistan, Mr Imran Khan, as required under clause (7) of Article 91 of the Constitution Islamic Republic of Pakistan,” the resolution said.

A total of 172 votes in the 342-member House was needed for a simple majority. The ruling coalition had 181 members but after the resignation of one of its lawmakers, Faisal Vowda, its strength was reduced to 180. The Opposition coalition has 160 members in the House. One seat was vacant.

The ruling Pakistan Tehreek-e-Insaf (PTI) had 157 members in the NA but following the resignation of Vowda, it now has 156 members in the National Assembly. The ruling party has said that Vowda can vote during the trust motion as his resignation has not been accepted yet. However, the Opposition insisted that he cannot vote as he has tendered his resignation.

The ruling party”s allies include seven from Muttahida Qaumi Movement (MQM), five each from the Pakistan Muslim League-Q (PML-Q) and the Balochistan Awami Party (BAP), three from the Grand Democratic Alliance (GDA) and one each from the AML and the JWP.

On Friday, Prime Minister Khan chaired a meeting of parliamentary parties at the Prime Minister House (PMH) in which all Members of the National Assembly (MNAs) of the ruling alliance were asked to vote for the prime minister otherwise they can be disqualified.

According to a Cabinet member, 175 lawmakers of the ruling coalition attended the parliamentary party meeting at PMH.

Khan also held separate meetings with leaders of the ruling coalition partners. All allied parties — the MQM, the PML-Q and the GDA pledged their support to him.( PTI)

BSF kills Pak intruder along IB in Rajasthan

Jaipur/New Delhi, Mar 6:

A Pakistani intruder was killed by the Border Security Force (BSF) along the Indo-Pak international border in Rajasthan, officials said on Saturday.

The man was moving in a suspicious manner and he was challenged by the troops. Later, he was shot dead near the border fence by a vigilant BSF trooper, officials said.

The incident took place around 8 pm on Friday in the Anupgarh area of Sri Ganganagar-Bikaner belt, they added.

The officials said the body of the Pakistani man was handed over to the local police and a search of the incident area is being carried out. (PTI)

Two non-locals arrested along with pistol at Jawahar Tunnel

QAZIGUND, MARCH 06:

The security forces have arrested two non-local residents during an operation near Jawahar Tunnel area of Qazigund in South Kashmir’s Kulgam district last night.

An official told the news agency—Kashmir News Observer (KNO) that two persons were arrested along with arms and ammunition after security forces intercepted a Santro car (JK04-9750) near Jawahar Tunnel, Qazigund.

One Pistol and twenty rounds were recovered from their possession, the official said.

The duo has been identified as Muhammad Danish Sedaqi, son of Shamshad Sedaqi and Muhammad Nawshad Nayi, son of Muhammad Younis Nayi from Rajatajpur in Uttar Pradesh.

The vehicle has also been seized and further questioning of arrested persons is going on, official said—(KNO)

Unidentified male body found in Bandipora village

BANDIPORA, MAR 06 :

An unidentified male body was found in Pannar village of North Kashmir’s Bandipora district on Saturday, officials said.

An official told the news agency—Kashmir News Observer (KNO) that some locals spotted a male body lying in Pannar village following which they informed Pethkoot police station.

He said that soon after the information was received a team of police rushed to the spot and took the body into their possession.

He, however, said that as per initial investigation the deceased was mentally unsound person and was roaming in the area since last night and was found dead in the morning.

He further said that his identification is being ascertained and investigation has been taken up—(KNO)

After 2 Months, SEC Orders Re-polling for DDC Seat in Drugmulla Constituency

PaK Born Female Candidate Permanently Excluded from Electoral Rolls on ‘Citizenship’ Grounds

KUPWARA, MARCH 6 :

After keeping the counting process in animation for nearly two months over antecedents of a PaK born female candidate contesting DDC elections from Drugmulla constituency, State Election Commission has finally announced nullification of the then held elections even as dropping the name of candidate in question permanently from electoral rolls.

State Election Commissioner in an order, of which a copy lies with GNS, maintains that a complaint was received by the polling authorities before the counting of votes schedule on 22-12-2020 against one Soomia Sadaf, contesting elections independently for DDC Constituency Drugmulla, alleging that she is not a bonafide Indian citizen. “The complaint mentioned that she is a resident of Muzaffarabad, PaK and an illegal entrant into the country and therefore is not a citizen of India”, the it states.

“On 21-12-2020, prior to the scheduled counting of votes for the Constituency (Drugmulla), Electoral Registration Officer (ERO), Panchayat (District Panchayat Officer) issued an order, deleting ab-intio name of Mst. Soomia Sadaf from Panchayat Electoral Rolls, Halqa Batergam.”

After deletion of the name from electoral rolls, DPEO/DC Kupwara sought further directions from Election Commission to which the latter responded by asking DPEO to defer the counting of votes besides seeking a status report from DC Kupwara as to know if any appeal was filed by the candidate against the ERO’s order on deleting her name from Panchayat Electoral Rolls, the order states.

The District Panchayat Election Officer (DC Kupwara) vide his communication no. DEOK/2021/2022-2023 Dated 24-02-2021, as per the order, confirmed that no appeal has been filed by the candidate.

The State Election Commission in exercise to the powers conferred under section 36 of Jammu and Kashmir Panchayati Raj Act, 1989 and subject to outcome of any writ petition pending before the Hon’ble High Court has thus declared the polling to the DDC constituency Drugmulla as void, cancelling the candidature of Soomia Sadaf ab-intio, ordering re-poll and redrawing of list of contesting candidates in the Constituency (excluding Mst. Soomia Sadaf).

“The re-poll of the Constituency shall be conducted under the applicable rules and guidelines on a date to be notified by the Election Authority through a separate order”, it reads further. (GNS)

1 death, 81 fresh covid-19 cases in J&K

SRINAGAR, MAR 05 :

Jammu and Kashmir reported 81 fresh covid-19 cases while one person died due to the virus in the last 24 hours, officials said on Friday.

Among the fresh cases, the officials told GNS that 61 cases were confirmed from Kashmir Valley and 20 from Jammu division, taking the total cases to 126853.

Giving district wise details, they said Srinagar reported 35 cases, Baramulla 9, Budgam 8, Pulwama 1,

Kupwara 0, Anantnag 3, Bandipora 1, Ganderbal 2, Kulgam 2, Shopian 0, Jammu 14, Udhampur 2,

Rajouri 0, Doda 0, Kathua 0, Samba 0, Kishtwar 0, Poonch 4, Ramban 0 and Reasi 0.

A number of cases were confirmed at diagnostic laboratories of SKIMS and CD hospital.

The SKIMS cases include female (35) from Kralpora Main Market Budgam, male (60) from Illahibagh, male (30) from Buchpora, male (29) from SKIMS Campus, female (02) from Munawara, female (36) and male (80) from Baghat, female (28) from Gulabagh, female (55) from Zainakadal, male (80) from Rawalpora, male (50) from Sakidafar, male (50) from Habak, female (60) from Gulabagh Srinagarand male (65) from Uttersoo Nagi Anantnag. Div Com Pandurang K Pole ordered establishing of COVID-19 facilities for students, staff

SRINAGAR, MAR 05 :

Divisional Commissioner Kashmir Pandurang K Pole on Friday ordered setting up of random rapid COVID-19 test facilities in Kashmir valley to prevent spread of infection among teachers and students.

In an order, a copy of which lies with the news agency—Kashmir News Observer (KNO) reads, “Deputy Commissioners of ten districts of Kashmir division are directed to put in place random rapid COVID-19 test facilities for educational institutions in order to prevent the spread of virus.”

The order reads that the schools in Kashmir opened from March-01-2021 and students of classes 9th to 12th are now attending their schools as per the guidelines by the Ministry of Health and Family Welfare, MHA and the divisional administration.

He said that as per the guidelines the students of class 5th to 8th are supposed to attend their classes from March-08—(KNO)

Farooq Moves HC Against ED Attaching His Property, Judge Recuses

SRINAGAR, MARCH 5 :

Jammu and Kashmir High Court judge, Justice Ali Mohammad Magrey, on Friday declined to hear National Conference president Farooq Abdullah’s petition against an ED order attaching his properties in a case of alleged money laundering.

“During the course of hearing of submissions of learned counsel for the petitioner (Farooq), I bethought that earlier in some matters arising out of somewhat identical basic allegations, I have declined to hear the case,” Justice Magrey said. “On confirmation it was revealed

that in fact, I have declined to hear the PIL No. 08/2014, titled Majid Yaqoob Dar and Anr. Vs. State and Ors., while sitting in the Division Bench with Mr. Justice N. Paul Vasantha Kumar, the then Chief Justice, by order dated 28.07.2015, passed therein and another case bearing LPA No. 293/2019 titled Ahsan Ahmad Mirza and Ors., Vs. Enforcement Directorate and Anr., while sitting in the Division Bench, by order dated 02.12.2019.”

In light of above, the judge said: “the judicial propriety demands the case be listed before some other Bench, on 08.03.2021.”

The ED has alleged that Abdullah misused his position as president of the J&K Cricket Association (JKCA) from 2001-2011 and made appointments in the sports body so Board of Control for Cricket in India (BCCI) sponsored funds could be laundered.

The former three-time Chief minister said the list of properties, valued around almost Rs 12 crore, attached by the ED in Kashmir and in Jammu were unrelated to the alleged activity mentioned in the Final Report/FIR.

The 83-year-old parliamentarian has said his ancestral and family properties in Jammu and Kashmir have been illegally attached by ED despite the fact that it had “no jurisdiction to do the same.”

“The illegal, excessive and arbitrary attachment of properties has resulted in grave injustice to the Petitioner, and is a continuing violation of his fundamental rights under Article 14 and Article 21 of the Constitution.”

In 2012, he submits that certain allegations regarding the siphoning off of JKCA funds emerged.

“As per the Final Report, these discrepancies were noticed by the then Treasurer, Manzoor Ahmed Wazir who brought it to the notice of the President (Farooq) who convened an immediate meeting of the Office Bearers of JKCA and subsequently an FIR No. 27/2012 dated 10.03.2012 under Sections 409, 406, 120B RPC was registered in PS Ram Munshi Bagh naming the erstwhile General Secretary and Treasurer namely Saleem Khan and Ahsan Ahmad Mirza as accused persons.”

He said along with initiating a police investigation regarding these allegations, Farooq submits that he constituted an In-House Probe Committee comprising of independent members of the Working Committee. “This Probe Committee submitted its interim report on 13.05.2012 and confirmed the embezzlement of funds by certain office bearers of the JKCA.”

He said ED’s 18 December 2020 action, attaching his properties, was illegal and arbitrary.

“A bare perusal makes it amply clear that the ED has simply adopted the case of the CBI and the resulting Final Report filed against the Petitioner (Farooq). Barring the recording of a handful of statements under Section 50 PMLA, no independent inquiry has been conducted into the present case, rendering it inherently biased,” he said, adding, “Nowhere has the ED satisfactorily offered reasons to believe the (Farooq) is in possession of proceeds of crime, or that such proceeds are likely to be concealed, transferred or dealt with in any manner which may result in frustrating any proceedings under the PMLA, as is required under Section 5 PMLA. Admittedly, the properties attached have no relation to the present case.”

He said that all properties attached by the ED are either ancestral or acquired by him prior to the date of the alleged offences. “The allegations against (Farooq) pertain to the period 2004 to 2009.The attached properties were acquired prior to the alleged commission of the offences, and hence were not involved in any alleged money-laundering or related criminal activity,” he said and sought directions to stay the proceedings pending before the Adjudicating Authority in relation to the “Original Complaint No. 1387 of 2021 during the pendency of the present petition.” (GNS)

Mehbooba Mufti summoned by ED on March 15 in money laundering case

Enforcement Directorate on Friday summoned PDP president Mehbooba Mufti for questioning on March 15th in a money laundering case.

PDP leader, who was released last year after more than a year in detention, has been served notice to appear at the ED headquarters in Delhi.

The case has been filed under the Prevention of Money Laundering Act.

Meanwhile Mehbooba Tweeted said GOIs tactics to intimidate & browbeat political opponents to make them toe their line has become tediously predictable.They don’t want us to raise questions about its punitive actions & policies. Such short sighted scheming wont work
