Nowshera Uri: Waiting for his regularization from last two years, Mohammad Muneer Lone- an ‘honest and dedicated’ Educational Volunteer (EV) converted as Rehbar-e-Taleem (ReT) teacher of Zone Boniyar passed away after battling cancer in his single story mud-house located at Nowranda village of Nowshera Boniyar nestled in the lap of lofty mountains.

Hounded by abject poverty, Muneer Hussain has been without salary from last one year as his regularization file faced worst kind of red-tapism in the office Director School Education Kashmir (DSEK) and the officers of education department didn’t bothered to give this teacher a helping hand in the tragic times.

“ Muneer joined the department as Educational Volunteer (EV) in 2005. He gave his precious years of life to education department and remained punctual to his duties with meager salary of Rs 1000. Later, government converted all EVs as ReTs and Muneer got converted in 2013. Now his regularization was due in 2018 as RRT but the file is facing red-tapsim and eats dust in DSEK,” said his colleague and neighbour teacher Zahoor Ahmad Mir.

“ Muneer shab  was punctual to his duties. He lived a simple life but deadly disease cancer attacked his lungs and later it spread to multiple organs. His family lived in abject poverty and he left his daughter, three sons and wife behind,” he added.

He added that he has no one to look after his devastated family as he was lone son of his parents who too had left him early.

Pall of gloom has descended on the Nowshera village and entire teachers’ community in Baramulla district is in utter shock and mourning as they have lost a colleague who, they allege, have became victim of marginalization and discrimination by the higher ups in the department despite fighting cancer disease.

“The regularization file of the deceased teacher is lying on the table of OSD DSEK but those at the helm of affairs hardly bother about the plight of teachers and their families. We demand immediate issuance of the regularization order in favour the teacher,” said District President Jammu and Kashmir Rehbar-e-Taleem Teachers Fourm  (JKRTTF)Mohmmad Yaqoob Bhat who was flanked by Provisional President Rahi Irshad and state Spokesman Rahi Irshad and District Secretary Reyaz Ahmad Ganai.

While expressing condolences on behalf of JKRTTF, Mohammad Yaqoob expressed solidarity with the family and prayed for the eternal peace to the departed soul.

“At this crucial juncture entire JKRTTF stand with the bereaved family. We will leave no stone unturned unless the family of our beloved colleague and respected teacher gets justice,” said District Secretary Reyaz Ahmad Ganai.   

The JKRTTF Zone Boniyar has demanded immediate intervention of the concern officers to speed up the process of regularization and issue the regularization order in favour the slain teacher so that his family gets benefitted under SRO 43 .

‘We want his salary and other arrears to be released immediately as family as suffered lot financially while get him treated for the carcinoma. Now the family is shattered,” said Zonal President Boniyar Shahnawaz Ahmad.

HC Disposes Of PIL Into Shopian ‘Fake Encounter’

Says PIL By Third Party Cannot, Should Not Be Entertained

SRINAGAR, DECEMBER 21:

Jammu and Kashmir High Court on Monday disposed of a petition filed in “Public Interest” into the “fake encounter killing” of three Rajouri youth this year, underling that the PIL by a third party cannot and should not be entertained.

Three youth— Abrar Ahmed (25), Imtiyaz Ahmed (20) and Mohammed Ibrar (16) were claimed to be militants and killed in a “gunfight” at Amshipora Shopian on July 18 this year. As they turned out to be innocents, on October 2, their bodies were exhumed in Baramulla and handed over to their families.

A bench of Acting Chief Justice Rajesh Bindal and Justice Puneet Gupta passed the orders as a petition filed by family members of three victims with “same prayer” is pending before the court Jammu’s wing.

“If the prayers made by the petitioner in the present petition are considered viz-a-viz the prayers made in the writ petition filed by the parents of the deceased, it would be evident that most of the prayers are common. Hence, a separate petition filed by the petitioner claiming the same to be in public interest cannot be entertained,” the court said as per GNS Correspondent.

Merely adding certain judgments of the Supreme Court laying guidelines with reference to the investigation of the persons killed in encounter will not make any difference as the matter raised by the parents of the deceased is already pending consideration in of the Court, the bench said.

“The provisions of law applicable or any judgment with reference to the subject matter can always be cited even if the same is not quoted in the pleadings,” the court said, adding, “The claim made is with reference to a specific incident for which the petitioner has not been authorized by the aggrieved party to raise a dispute.”
The PIL was filed by Jammu & Kashmir Reconciliation Front through its chairman Dr Sandeep Mawa.

Further, the court said, once the parents of the deceased can approach the Court by filing a petition prior in time, they can always raise whatever grievance they have.

“In such a situation, public interest petition filed by a third party cannot and should not be entertained as he has no locus or cause of action to raise that dispute,” the court said as per GNS, adding, “It cannot be said to be in larger public interest as the guidelines for investigation in such type of cases have already been laid down by the Supreme Court in the cases referred to by the petitioner himself.” (GNS)

Examine Setting Up Of Human Rights Commission In J&K: HC Tells Govt

SRINAGAR DECEMBER 21 :

The Jammu and Kashmir High Court on Monday asked the government to examine matter regarding setting up of a Human Rights Commission in J&K.

After the promulgation of the J&K Reorganization Act 2019, the Jammu and Kashmir State Human Rights Commission ceased to exist from 31 October last year.

“The matter especially with reference to the provisions of Section 21(7) of the Act of 1993 needs to be examined by the Government so that proper remedies are available with the aggrieved persons, who are having any grievance regarding violation of their human rights,” a bench of Acting Chief Justice Rajesh Bindal and Justice Puneet Gupta said.

The petitioner—chairman Jammu & Kashmir Reconciliation Front through its chairman Dr Sandeep Mawa— had said that Section 21 of the Protection of Human Rights Act, 1993 provides for constitution of Human Rights Commissions in every State and the Union Territory.

In the absence of a forum, Mawa had said that the aggrieved parties are not able to get redressal of their grievances.

“Prior to the enactment of the Reorganization Act, the Jammu & Kashmir Protection of Human Rights Act, 1997 was applicable in J&K. In exercise of powers conferred thereunder, the J&K State Human Rights Commission had also been constituted, which was wound up after the enactment of the Reorganization Act. The residents of J&K, if having any grievance regarding violation of their human rights, may have to approach the National Human Rights Commission,” the court said as per GNS.

As far as the Constitution of Human Rights Courts in the Union Territory of J&K is concerned, needless to add that vide notification dated 07.02.2019 issued by the Department of Law, Justice and Parliamentary Affairs, Government of J&K, the Court of the learned Principal Sessions Judge of each district has been designated as Human Rights Courts. Hence, the grievance of the petitioner to that extent does not survive.

As regards the Constitution of Human Rights Courts in the J&K is concerned, the court said: “needless to add that vide notification dated 07.02.2019 issued by the Department of Law, Justice and Parliamentary Affairs, Government of J&K, the Court of the learned Principal Sessions Judge of each district has been designated as Human Rights Courts.” (GNS)

Covid-19 claims 3 more lives, J&K toll 1844

SRINAGAR, DECEMBER 21:

Jammu and Kashmir reported three more deaths due to the covid-19 in the last twenty fours, taking the fatality count to 1844 in J&K.

Two among the victims belonged to Kashmir Valley division and one to Jammu, officials told GNS on Monday.

The victims include a 70-year-old man from Khalmulla Ganderbal and a 70-year-old woman from Natipora Srinagar besides one from Jammu district.

With these deaths, the total fatality count in J&K reached 1844—1168 in the Valley and 676 in the Jammu region.

Srinagar district with 443 deaths tops the list followed by Jammu (344), Baramulla (170), Budgam (106), Pulwama (88), Kupwara (88), Anantnag (82), Doda (60), Bandipora (58), Udhampur (52), Kulgam (53), Rajouri (54), Kathua (48), Ganderbal (43), Shopian (37), Samba (36), Poonch (22), Ramban (21), Kishtwar(21), and Reasi (13).(GNS)

DPEO stressed for impartial, transparent counting

KUPWARA, DECEMBER 21:

District Panchayat Election Officer (DPEO) Kupwara, Anshul Garg, today finalized arrangements for counting of District Development Council (DDC) votes being held on December 22.
ADC Handwara, Nazir Ahmad Mir; Deputy District Panchayat Election Officer, Bashir Ahmad Bhat; Returning Officers, Assistant Returning Officers, Counting Supervisors, Master Trainers and other concerned were present in the meeting.
The DPEO urged the concerned officers for impartial and transparent counting process while taking in confidence all party agents. He said counting shall be started from 9 AM at 04 Counting Centres viz. ITI Kupwara, JNV Potushai, ITI Handwara and Mini Secretariat Tangdar, adding that Nodal Officers have already been appointed for providing logistic support to respective ROs to ensure smooth counting. He said transport and refreshment facilities shall be provided to the officials involved in the counting process. The DPEO also directed for counting of postal ballots and migrant votes.
The DPEO directed the concerned ROs that opening of Strong Rooms shall be videographed.
The meeting discussed other requisite facilities including parking of vehicles, heating and power supply arrangements and concerned officers were directed to do the needful.
Earlier, Master Trainer, G. M. Dar apprised the concerned officers about the procedure and necessary technical knowhow for smooth conduct of the counting.

Handwara Police distributed Covid-19 Protection Kits among families living Below Poverty Line

Handwara Police continued its efforts to reach out the needy and poor families living below poverty line who were effected badly due to pandemic Covid-19. In this regard, HandwaraPolice added helpful gesture and distributed COVID-19 protection kits under civic action programme of J&k Police among poor and needy families residing in the jurisdiction of Police District Handwara who cannot effort to purchase such protection/ Safety kits. Each kit consists of masks, Sanitizers, Oximeter, Inhalers, Thermometer, Soaps, Shields and other essential items for virus protection. A medical team from District Hospital also participated the distribution function and performed a detailed demo about how to use these items provided to them.

The distribution function was held at DPL Handwara where protection kits were distributed by Superintendent of Police Handwara Dr. G.V. Sundeep Chakravarthy-IPS besides DYSP DAR Handwara Shri Raqeeb Malik-JKPS and other officers of Police were also present present on the occasion.

On the occasion, SP Handwara said, ” Handwara Police early took initiative on the out break of universal pandemic Covid-19 to reach out the poor and needy families especially residing in the far flung areas of this Police District who were badly effected during Covid-19 lockdown period. In this connection, today’s distribution programme of Covid-19 safety kits is to provide such items among these families as a mark of helpful gesture”.
People in general have appreciated the role of Handwara Police while tackling pandemic COVID-19 from initial stage till now.

DDC election results will be accessed online dynamically: SEC Sharma

‘Tomorrow’s counting to decide fate of 2178 candidates’

The State Election Commissioner (SEC), KK Sharma on Monday said that the District Development Council (DDC) election results would be accessed online dynamically.
The SEC stated this while interacting with the Media persons here today.

While briefing the media about the availability of election results on a website: http://ceojk.nic.in, the SEC stated that the State Election Authority would facilitate people and media alike to access election results and trends on a dynamic basis.

He said that soon after the randomization and time-tested protocols the ballot boxes would be opened and ballot papers would be mixed subsequently for counting and added the updated information would be given to the people on the website.

The SEC added that tomorrow’s counting would decide the fate of 2178 candidates for 280 DDC seats and counting would begin at 9 am.

He also informed that the overall voting percentage in all eight phases across the Union Territory is 51.42 percent and tomorrow over thirty lakh votes would be counted at counting centres.

While giving a demonstration, Secretary State Election Commission, Anil Salgotra briefed the media persons about the functioning of the website. He said that people along with the media would be able to have access to the counting trends, final results and party-wise trends for all 280 DDC constituencies.

He added that the website can also be accessed for trends with respect to particular constituency in a given district and particular party, besides the information for top two leading candidates and the overall votes polled for all the candidates can also be accessed.

Update: Court orders framing of charges against Aasiya Andrabi

NEW DELHI DECEMBER 21 :

A Delhi court Monday ordered framing of charges against Kashmiri separatist Aasiya Andrabi and her two associates for allegedly waging war against the Government of India, sedition and conspiracy to commit terror acts in the country.

Special Judge Parveen Singh ordered putting Andrabi as also Sofi Fehmeeda and Nahida Nasreen on trial for various offences punishable under IPC and stringent Unlawful Activities (Prevention) Act (UAPA).

According to the FIR, Andrabi, Fehmeeda and Nasreen were actively running an allegedly terrorist organisation named ”Dukhtaran-E-Millat” (DEM) which is proscribed under the First Schedule to the UAPA.

The three accused were arrested in April 2018 and are currently in custody. (PTI)

Dangiwacah: A week long plantation drive organized by forest department’s Langate Forest Division under “Green J&K drive” in collaboration with District Legal Services Authority (DLSA) Baramulla and a reputed social organization Human Aid Society Kashmir concluded at Government Higher Secondary School Dangiwacah in Rafiabad Baramulla on Monday.

Secretary DLSA Faizan- ul -haq Iqbal was the chief guest and Tehsil Chairman DLSA   Dangiwacha Eisar-u-al Nabi was the guest of honor while as Divisional Forest Officer (DFO) Langate Abdul Hameed Malla, District Information Officer Mudasir Ahmad Chowdary, Chairman Human Aid Society Kashmir Bashir Ahmad Mir and Principal GHSS Manzoor Ahmad were special guests.

While addressing the gathering, chief guest, Secretary DLSA Faizan-ul-Haq Iqbal whi said that forests play a vital role in maintaining ecological balance besides urged upon various stakeholders to play an active part in this regard.

“It must be the duty of every conscious citizen to involve in this drive and plant more trees so that future generations could be saved from the disastrous consequences of the environmental degradation,” said Faizan-ul-haq Iqbal.

He highlighted the importance of plantation drive in and briefed audience about role of forest department and NGO’S in making the plantation drive success.

Replying to the concern of soil erosion raised by the Chairman Human Aid Society Kashmir, he replied that soil conservation department is going to introduce seed based plantation at land erosion prone places so that plants would grow naturally to prevent the land erosions.
