12 bore Rifle snatching bid repulsed in Shopian

Suspected militants tried to snatched 12 bore Rifle from JK Bank guard at Imamsahib area of South Kashmir’s shopian here on Saturday.

Official sources told GNS that suspected militants tried to snatch 12Bore rifle from JK Bank guard at Imam Sahib. However the police thwarted the rifle snatching attempt.

A person has been also arrested in this connection, they said. More details will follow.(GNS)

Farooq Abdullah Hospitalized, Days After Testing Covid-19 Positive

SRINAGAR, APRIL 3 :

National Conference president Farooq Abdullah was hospitalized on Saturday, few days after he tested positive for the novel coronavirus.

“Based on the advice of doctors to enable them to better monitor my father, he has been admitted to hospital in Srinagar,” Omar Abdullah, his son, tweeted. “Our family remains grateful to everyone for their messages of support & their prayers,” Omar, National Conference vice president and former Chief Minister of J&K, said as per GNS.

On March 30, Farooq, who is Lok Sabha member from Srinagar, tested positive for the virus, four weeks after getting covid-19 vaccine jab.
Abdullah, 85, was given the first dose of the vaccine at the Sher-e-Kashmir Institute of Medical Sciences, Soura on March 2.

Prime Minister Narendra Modi also wished Farooq Abdullah, a speedy recovery.
“Praying for the good health and speedy recovery of Dr. Farooq Abdullah Ji. Also praying for your and the entire family’s good health @OmarAbdullah,” he tweeted.

Omar promptly replied to him, saying, “My father and the rest of the family join me in thanking you for your wishes and prayers @narendramodi ji.”

Former chief ministers N Chandrababu Naidu and Mehbooba Mufti, among others, also wished for Farooq’s speedy recovery. (GNS)

Body of Pattan man who died last month exhumed after family suspects murder

PATTAN , APRIL 2 :

Body of a 32-year-old man who was found dead under mysterious circumstances in Rangi village of pattan in Baramulla a month ago was exhumed today.

According to the KNS Correspondent, body of the man was spotted outside the house of inlaws in early morning last month and it was assumed as case of Heart Attack.

A Police team had taken the body and pressed for postmortem, however then his family and his in-laws family’ did not allow it and buried the body.

According to locals, the deceased was living with his in-laws and now the family of the deceased suspect murder of their Son and asked police to investigate the cause of death.

Accordingly on the Directions of Deputy Commissioner Baramulla, it was ordered to reopen the Grave and ascertain the facts of cause of his death, Officials told KNS.

However according to Police officials, the medico-legal formalities have been conducted and specimens sent to FSL for further investigation in this regard.

The deceased was identified as Mohmmad Altaf Malik Son in law of Late Abdul Razak Ganie, resident of Rangi Pattan.(KNS)

School in Kupwara Closed For 3 Days As Female Trio, Lecturer Test COVID Positive

SRINAGAR,, APRIL 2 :

:Authorities have directed for closure of a Higher Secondary school in north-Kashmir’s Kupwara district for five days after at least three girl students alongside a middle-aged lecturer tested positive for COVID-19.

Block Medical Officer (BMO) while talking to GNS said that three female students, all currently admitted in Class 11, besides a 40-year-old lecturer tested positive for the infection at Government Higher Secondary School Harie. “All the infected persons were immediately isolated”, the official said.

Meanwhile Chief Education Officer (CEO) Kupwara Abdul Hamid Fani has directed for closure of the institute for next five days, with effect from following Saturday. “The institute will remain closed for next five days, and upon its opening all the students and lecturers will tested again as a precautionary measure to rule out any exigency”, the official told Global News Service.

Farooq’s ED Attachment ‘Provisional’, No Interim Order Needed: HC

Jammu and Kashmir High Court has said that Enforcement Directorate’s order, attaching National Conference President Farooq Abdullah properties in a case of alleged money laundering was just provisional and as such it does not consider it to be “an appropriate case to pass any interim order at this stage.”

“In view of the facts and circumstances and looking to the fact that presently the petitioner (Farooq) has only been served with a show cause notice in which we are told 20th April, 2021 is the next date fixed and the fact that the order of attachment is provisional in nature which is valid for a period of 180 days only, we do not consider it to be an appropriate case to pass any interim order at this stage particularly when the laundering of Rs 43.69 crores of the amount is not in dispute which in all fairness ought to be returned to the public body i.e., JKCA,” said a bench of Chief Justice Pankaj Mithal and Justice Vinod Chatterji Koul as per GNS correspondent.

The court directed officials to file their counter affidavit to the Farooq’s petition within a period of three weeks and also allowed one week thereafter to the octogenarian to file rejoinder affidavit.

Farooq, the former three-time Chief Minister of J&K, has challenged the action of the Authorities under the PML Act, among others on the issue of jurisdiction, the applicability of PML Act to the erstwhile State as also on grounds of illegality and procedural irregularities.

The 83-year-old parliamentarian has said his ancestral and family properties in J&K have been illegally attached by ED despite the fact that it had “no jurisdiction to do the same.”

Sidharth Luthra, Senior Counsel, representing Farooq Abdullah referred to various provisions of the PMLA and submitted that Farooq can only be proceeded under the PMLA in connection with the scheduled offence as per the Schedule-A of the Act.

“The offences under Sections 406 and 409 of RPC are not the scheduled offences and merely for an offence under Section 120-B RPC, the petitioner (Farooq) is not liable to be proceeded with under the PMLA”.

Moreover, he said, the Schedule enlists the offence of criminal conspiracy under Section 120-B Indian Penal Code as one of the scheduled offences and does not refer to any offence under RPA muchless under Section 120-B RPC. “The order of provisional attachment does not contain any reason to believe nor does the properties inherited by him or received in gift from his ancestors or any property which has been privately acquired by him are liable to attachment as they are not “proceeds of the crime”.”

The order of provisional attachment, he said, greatly undervalues the properties attached so as to attach almost all the properties of Farooq. “Therefore, the entire proceedings are without jurisdiction and are malafide.”

Solicitor General in defence submitted that the PMPLA has been enacted by the Parliament in view of the political declaration adopted by the Special Session of the United Nations General Assembly calling upon the member states to adopt national money laundering legislation. “India being the member State accordingly enacted the aforesaid Act extending it to the whole of India,” he said, adding, “Thus, it cannot be said that the aforesaid enactment is beyond the legislative competence of the Parliament.”

He refers to Section 2(2) of the PMLA to contend that any reference in the Schedule to the Act to any enactment or provision which is not in force in the “area” where it is applicable would be construed as a reference to the corresponding law or the corresponding provision, if any, in force in that “area”.

“Thus, as the Act is applicable to the whole of India, it is applicable to the Jammu & Kashmir also and the reference to Section 120-B in the Schedule to the said Act refers to Section 122-B of RPC as they are corresponding and pari materia.”

After hearing both sides, the court said that an attempted to rely upon certain precedents which “we need not to discuss as we are not adjudicating upon the various issues raised at this stage without giving an opportunity to the respondents to file their response.”(GNS)

ACB traps and arrests Sub Inspector Gh. Mohammad Bhat of Police Station Serigufwara, Anantnag for accepting bribe

Anantnag:Anti Corruption Bureau received a complaint alleging therein thatquarrel took place between complainant and one person who was the resident of village Dupathyar Anantnang. On this the non complainant filed a complaint (applicant therein) against the applicant (complainant herein with respect to ACB) in Police Station Serigufwara District Anantang.

  1. On this issue, complainant was called by the Police Station Serigufwara and was detained for some time. He was released and was directed by the 2nd Officer of the police station to report on next morning.Yesterday the complainant was informed Sub Inspector Gh. Mohammad Bhat, second officer of the said Police Station on phone that few other persons including the complainant are also involved in this case. The second officer of the Police Station also assured the complainant that if he pay Rs. 7000/- then no further proceedings will be taken against him.
  2. On receipt of the complaint, a case FIR No.07 of 2021 under section 7 Prevention of Corruption Act, 1988 was registered in Police Station ACB Srinagar and investigation was taken up.
  3. A trap team was constituted. The trap team laid a successful trap and during the process, Sub Inspector Gh. Mohammad Bhat demanded and accepted the bribe through one private person at his instance. The amount of bribe to the tune of Rs. 7000 was also recovered on the spot. The Sub Inspector was arrested and taken in custody by ACB Team.
  4. Further investigation in the case is going on.

Covid-19 shows resurgence as J&K reports 5 deaths, 517 positive cases

In what shows the resurgence of Covid-19 deadly pandemic, J&K Friday recorded 517 positive cases, biggest ever in the ensuing year so far.

As per the official figures available with the news agency—Kashmir News Observer (KNO), in total 517 positive cases were reported in the UT of which the Srinagar tops the list at 173 cases, followed by Baramulla at 86, Budgam, 88, Pulwama 04, Kupwara 12, Anantnag 12, Bandipora 14, Ganderbal 09, Kulgam 21 and Shopian 02.

“Jammu recorded 62 positive cases, Udhampur 01, Rajouri 07, Doda 06, Kathua 14, samba 03, Kishtwar 00, Poonch 00, Ramban 03 and Reasi 00,” the official figures revealed.

COVID-19: Three more schools closed for three days in Bandipora

Bandipora, April 02:

Authorities on Friday announced the closure of three educational institutions in north Kashmir’s Bandipora district for the period of three days with effect from Friday as a precautionary measure in the wake of the Covid-19 positive contacts.

An official told the news agency—KNO, that as per the communication recieved from District Administration Bandipora, the schools including Higher Secondary School Gadkhud, High School Chewa and (IDPS) School Bandipora shall remain closed for three days as per covid-19 protocol.

However, concerned schools shall ensure testing and sampling of staff and students as per the directions from Covid Control Room, which will be shared as soon as communicated by the Health department.

He said that these Schools have been closed after some close contacts of previous Covid-19 postive patients were found.

On last Wednesday, the authorities ordered closure of a Government Higher Secondary School in Kaloosa locality of the district after a Lecturer at the School tested positive for COVID-19.

Covid-19 Surge: Govt Asks DCs To Take Call On Keep Open Or Closing Schools In J&K

SRINAGAR,, April 02 :

: Amid rising number of covid-19 cases lately, the government on Friday said that deputy Commissioners (DMs) shall take call on keeping open or closing the schools in respective districts in Jammu and Kashmir.

“…decision regarding running of physical classes vis-à-vis online classes requires to be taken at district level by the Competent Authority.

I am directed to convey that all the District Magistrates/Chairman DDMAs of Kashmir/Jammu Division(s) shall take a call on the continuation of academic activities i.e. physical classes or online classes in their respective jurisdiction, keeping in view the safety of the students and present trend of Pandemic COVID-19 in different districts,” reads an order Umesh Sharma, Deputy Secretary to the Government.

“Chief Education Officer and other authorities will assist in taking such decisions,” the order, a copy of which lies with GNS, adds.

The order also referred to various Government Order(s) regarding re-opening of schools and guidelines on COVID containment measures in J&K. The order said detailed SOPs were mentioned to be followed for opening of schools across J&K. It has been observed that surge of pandemic COVID-19 has wide variation among districts. (GNS)

Inspector General of Police Kashmir Zone Vijay Kumar on Friday said that attack on BJP leader’s house was carried jointly by militants from Al-Badr and Lashker-e-Toiba and those belonging to latter were killed in a gunfight at Kakapora Pulwama in less than 24 hours.

Addressing a presser here, the top police officer of Kashmir also said that three more persons have been arrested and the vehicle used in the attack belonged to one in whose house the encounter took place at Ghatmohalla area of the Kakapora in the south Kashmir district

“As you know, militants carried attack at Nowgam Srinagar on BJP leader’s house and policeman was killed and a rifle snatched,” he said as per GNS.

“Srinagar and Pulwama police swiftly moved and in the process arrested a person on whose disclosure two more persons were arrested and ultimately it was revealed that three militants are hiding in house at Ghatmohalla,” he said, adding, “CASO was launched and Security forces were fired upon following they retaliated.

Initially 4 civilians were kept hostage and later they were freed which took time for conclusion of the operation.”
He said that three militants identified as Suhail Lone and Nissar Lone besides one Junaid were killed in the gunfight.

“Suhail Lone had come in Burqa,” the IGP said, adding, “ An Ak-47 rifle, a pistol and one SLR which was snatched from the policeman have been recovered. “

The recovery of the SLR, he said, proves that these militants were involved in the Nowgam attack.

“One new thing has emerged that it was the attack carried in unison by Al-Badr and LeT. Initially we thought all four militants were from Srinagar and were from LeT,” he said.

The militants, he said, had come in an Alto vehicle (JK01E-2098) which has been seized from the house of one Nawaz Dar and he is being booked. “The vehicle belongs to him and it helped us to track the militants immediately,” he said. He said that two other militants who were part of the attack belonged to Srinagar and remained in summer capital of J&K. “Those from Pulwama left and were killed.”

He said one lady suffered minor injuries in cross firing while two or three persons were injured in stone pelting at the gunfight site.

Asked if the BJP leaders faced more threat than others in the Kashmir, the top police officer responded in affirmative.

“As far as I am came concerned, threat is for all political parties. Every person and every party has different threat and I accept that BJP have more threat,” he said, adding, “We are strengthening bunkers and other deployed. We are giving more training to policemen on guard duty so that they can neutralize militants on their own immediately.”

He said SOPs and PSO guard changes are being made. “We are also not deploying those from areas as they go home frequently.”

Asked if the infiltration has come down as claimed by the DGP, he said, “One of the militant (killed) had come recently. May be he had come through Nepal.”

To a question, he said that young people are radicalized on social media by Pakistan and don’t fear. “They are not aware about their family and career,” he said, adding, “I also requested teachers community to play role. Parents have role and also media men.”

He said that six militants are active in Srinagar city and “they will soon be neutralized, arrested or brought back.” (GNS)
